Genetic illness no reason to the resignation for health insurance

- private health insurances cannot withdraw because of a genetic illness from the insurance contract, so a decision of the regional court Bielefeld of 14.02.07 (Az. 25 O 105/06).

Regarding the Thalassaemia taken by the deplored health insurance for the resignation to the cause minor already it speaks against an importance of this circumstance that it concerns a change of the red blood corpuscles caused by a gene defect. Genetic defects are not included meanwhile at present into the calculation by health insurances. The general association of the German insurance economy registered association, to which also the deplored one belongs, has to require rather a freiwillige self obligation explanation of the member enterprises closed, in which these obligate among other things itself to make at least until 2011 neither gene tests the condition of a conclusion of a contract still from their customers to, freiwillige gene test to submit. To that extent expressly without the duty to give notice embodied in the VVG one does. Findings submitted also nevertheless may not be used thereafter. This applies thereby also to the Thalassaemia minor.
